clutch/ brake wont release yardman #13bx694g401 16hp 42"cut?

i just picked this mower up, and the rearend is locked up, wont go into neutral. i took the battery out to get a look at the rearend, and noticed that when i push the clutch/brake petal down it does not move the lever attatched to he rearend, and the parking brake seem to be stuck as well. could this be a simple replace the lever and grease it up fix, or will i need to repair/ replace the hydrostatic drive assembly?
